Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Malaysian Chinese Tourism Association (MCTA) membership portal available at https://www.mcta.com.my (the "Portal"), including membership registration, renewal, event registration, document submission and all related online services. The Portal is operated by Malaysian Chinese Tourism Association (MCTA) ("MCTA", "we", "us" or "our"), a society registered in Malaysia.

By registering for an account, submitting a membership application, making a payment or otherwise using the Portal, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Portal.

Where you use the Portal on behalf of a company, firm or other organisation, you represent that you are duly authorised to bind that organisation, and "you" refers to both you and that organisation.

2. Eligibility and Membership Categories

Membership of MCTA is open to businesses operating in the Malaysian tourism and hospitality sector, including but not limited to inbound travel agencies, outbound travel agencies, ticketing agencies, MM2H agents, spas, theme parks, hotels and restaurants.

To be eligible for membership, an applicant must:

• be a legally constituted business entity registered in Malaysia;
• hold all licences and permits required by law for its business activities, including (where applicable) a valid MOTAC licence;
• provide true, accurate, current and complete information in its application; and
• agree to abide by the MCTA Constitution, by-laws, codes of conduct and resolutions of the Committee.

Membership is offered on a one-year or lifetime basis, as selected during registration and subject to the applicable fees published on the Portal from time to time.

3. Registration and Approval

Submission of an application through the Portal does not create membership. All applications are reviewed by the MCTA secretariat and are subject to approval by the Committee. MCTA may approve, reject or request further information in respect of any application at its sole discretion, and is not obliged to give reasons for a rejection.

Applicants must upload supporting documents as prompted by the Portal, which may include the company registration certificate, SSM certificate, business licence, MOTAC licence, company stamp and other supporting documents. Documents must be legible, unaltered and current.

Your membership becomes effective only upon written or electronic confirmation of approval from MCTA and receipt in full of the applicable fees.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and one-time passwords, and for all activity carried out under your account. You must notify us immediately at admin@mcta.com.my if you suspect any unauthorised access or use.

You must not share your account with any person outside your organisation, attempt to gain unauthorised access to any part of the Portal, interfere with its operation, or use automated means to extract data from it.

5. Fees, Payment and Receipts

Membership registration fees, annual renewal fees, event fees and any other charges are as published on the Portal at the time of the transaction. All fees are quoted in Malaysian Ringgit (MYR) and, unless expressly stated otherwise, are exclusive of any applicable taxes, bank charges or payment gateway fees.

Payments may be made through the payment methods made available on the Portal, which may include FPX online banking, credit or debit card, DuitNow and manual bank transfer. For manual bank transfers, membership or registration will only be processed after proof of payment has been uploaded and verified by the secretariat.

An official receipt will be issued electronically through the Portal upon confirmation of payment. Payments are processed by third-party payment providers; MCTA does not store your full card or banking credentials.

6. Renewal, Expiry and Lapse of Membership

One-year memberships expire on the date shown in your member profile. The Portal will issue renewal reminders before expiry, but it remains your responsibility to renew on time. Failure to receive a reminder does not extend the renewal deadline.

Renewal fees paid after the expiry date may attract a late payment penalty as determined by the Committee, unless a penalty waiver applies under a promotion or ruling in force at the time. Membership that remains unrenewed beyond the period stated in the MCTA Constitution may be suspended or terminated, and reinstatement may require a fresh application and payment of registration fees.

7. Member Obligations

As a member, you undertake to:

• keep your company profile, contact details, delegate details and uploaded licences accurate and up to date;
• submit updated documents promptly when a licence or certificate expires or is renewed;
• conduct your business lawfully, ethically and in a manner that does not bring MCTA or its members into disrepute;
• comply with all directions, warning letters and disciplinary decisions issued by MCTA; and
• not use the MCTA name, logo, membership number or membership certificate in any misleading manner or after your membership has ceased.

Changes to certain profile information submitted through the Portal take effect only after review and approval by the secretariat.

8. Suspension, Warning and Termination

MCTA may issue a warning letter, suspend or terminate your membership and your access to the Portal, with or without notice, where you breach these Terms, the MCTA Constitution or any applicable law; where fees remain unpaid; where information or documents supplied are false, misleading or falsified; or where your conduct is prejudicial to the interests of MCTA or its members.

You may resign or surrender your membership by written notice to the secretariat. Resignation does not relieve you of liability for fees already due, and fees already paid are dealt with under the MCTA Refund and Cancellation Policy.

9. Events and Programmes

Registration for events, training programmes and activities organised through the Portal is subject to available capacity and to any additional terms notified at the point of registration. MCTA may change the date, venue, programme or speakers of an event, or cancel an event, where reasonably necessary.

10. Content and Intellectual Property

All content on the Portal, including text, graphics, logos, layout, member directory listings and downloadable materials, is owned by or licensed to MCTA and is protected by applicable intellectual property laws. You may access and print such content for your own internal business use only, and may not reproduce, republish, distribute or commercially exploit it without our prior written consent.

By uploading company logos, profile descriptions, documents or other material to the Portal, you grant MCTA a non-exclusive, royalty-free licence to host, reproduce and display that material for the purposes of operating the Portal, verifying your membership, publishing the member directory and promoting MCTA activities.

You warrant that material you upload does not infringe the rights of any third party and is not unlawful, defamatory, obscene or misleading.

11. Member Directory and Publicity

Approved members may be listed in the public member directory on the Portal, showing information such as company name, membership category, business address, contact details and logo. If you do not wish specific details to be published, you must notify the secretariat in writing.

12. Availability of the Portal

We aim to keep the Portal available at all times but do not guarantee uninterrupted or error-free access. The Portal may be unavailable during maintenance, upgrades or circumstances beyond our reasonable control. We may modify, suspend or discontinue any feature of the Portal at any time.

13. Third-Party Links and Services

The Portal may contain links to, or integrate with, third-party websites and services, including payment gateways, email delivery services and social media platforms. MCTA does not control and is not responsible for the content, policies or practices of those third parties.

14. Limitation of Liability

The Portal and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MCTA excludes all warranties, express or implied, in relation to the Portal.

MCTA shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, goodwill or data, arising out of or in connection with your use of the Portal. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Information published in the member directory is supplied by members. MCTA does not warrant its accuracy and is not a party to, and accepts no liability in respect of, any dealings between members or between a member and a third party.

15. Indemnity

You agree to indemnify and hold harmless MCTA, its office bearers, committee members, staff and agents against all claims, losses, liabilities, costs and expenses arising from your breach of these Terms, your misuse of the Portal, or any material you submit through it.

16. Personal Data

Personal data collected through the Portal is processed in accordance with the MCTA Privacy Policy and the Personal Data Protection Act 2010 (Malaysia). By using the Portal you acknowledge that you have read the Privacy Policy.

17. Amendments

MCTA may amend these Terms from time to time. The revised Terms take effect from the date they are published on the Portal. Your continued use of the Portal after publication constitutes acceptance of the revised Terms. Material changes will, where practicable, be notified by email.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia. The parties submit to the exclusive jurisdiction of the courts of Malaysia. Any dispute arising between MCTA and a member concerning membership shall first be referred to the Committee in accordance with the MCTA Constitution before legal proceedings are commenced.

19. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force. Failure by MCTA to enforce any provision is not a waiver of its right to do so later.

20. Language

These Terms may be made available in English and Chinese. In the event of any inconsistency between versions, the English version prevails.
